TERMS & CONDITIONS of SALE
We are a Business to Business Supplier Only and therefore by purchasing from us You Also Warrant that you are a business or commercial user and have Read and Accepted the following Terms & Conditions of Sale:
All purchases are subject to UK Law and no contract will exist between you and us until we have confirmed in writing (by e-mail, letter or invoice) that we have accepted your order and are processing it. Consequently, we shall not be bound by any conditions inconsistent with these Conditions of Sale which may be contained in any order sent to us.
Goods are not sold to businesses or commercial users on a trial basis or on approval and therefore are not subject to the Distance Selling Regulations 2000. We want you to be entirely happy with your purchase and so, if you are unsure as to the suitability of a product, please ask before purchasing it.
PRICES & SPECIFICATIONS
All prices exclude VAT @ 20% (or 5% for fuel oils) which will be added at the checkout. We try to ensure specifications or prices are up to date at any given time and prices are displayed on an "invitation to treat" basis but if we are unable to supply something you have ordered at an advertised price or of the same specification, we will give you the option to either accept an alternative, pay any difference or cancel your order with an immediate refund.
Please be aware that variations in PC monitors and photographic reproduction may mean that products you view are not exactly the colour you will receive. Notwithstanding, we reserve the right to send you whatever colour is available from stock (especially with regards to consumables) unless you specifically request a particular colour preference. Errors & Omissions Excepted (E&OE)
Full payment is required at the time of ordering. We accept credit and debit card payments via PayPal and therefore do not have access to your card details, nor will we request them. We also accept payment by cheque (at no extra charge) but goods will not be despatched until your cheque has cleared, usually up to 5 working days after receipt. If any payment of yours is dishonoured, we reserve the right to recover our administration and bank costs. In the case of a returned cheque, a charge of £12.00 + VAT will be levied each time it is returned unpaid. Overdue invoices will attract interest at 2.5% per month or part thereof and title will only pass upon payment in full.
Official Purchase Orders from United Kingdom Local or County Councils, Police, Fire, Ambulance, Government, NHS, Schools, Ministry of Defence and other Public Sector Bodies etc. will be accepted if attached to the order confirmation you will receive having chosen the "Payment by Cheque/BACS/Purchase Order" option but we shall not be bound by any conditions inconsistent with these Conditions of Sale which may be contained in any order sent to us. The same terms apply to UK PLC's, Limited Companies or Businesses which have pre-approved accounts with us. Should you wish to pay via BACS or CHAPS transfer, please let us know and will notify you of our bank account details. In all cases, payment is required strictly within 30 days or as otherwise agreed to secure any discounts given.
We will endeavour to despatch your order within the promised timescale and by your preferred delivery method but our maximum liability for any delays will not exceed the cost of the delivery method paid for. If an item is out of stock, we will advise a due delivery date and you will be at liberty to either await delivery or request a full refund. We also reserve the right to split your order and make separate deliveries in the event that part of an order is temporarily out of stock or your chosen delivery method does not allow for different product categories to be packed together. If this is necessary, we will not charge you any additional carriage fees.
Large items of equipment or plant will be delivered, installed and commissioned by an engineer directly to your premises within our Standard Service Area. Although delivery may take a little longer, we aim to offer you total peace of mind knowing that the equipment is correctly set up, it is working properly to its design potential - and that you are fully familiar with its features, machine operation and maintenance requirements, as well as any Health & Safety issues. Accordingly, once we have received your order, we will liaise with you as to a convenient delivery date. Bespoke, made-to-order items or in-plant installations will be delivered or installed in accordance with any quotation.
We will do our utmost to effect prompt delivery but we will not be liable for delays caused by our delivery contractors. Upon delivery, please ensure you thoroughly check consignments for shortages or damages before signing receipt as our delivery contractors will not accept responsibility if you have not indicated any damages or shortages on the delivery note. Shortages or Damage must be reported upon delivery AND in writing within 48 hours. All notifications for Non-Delivery must be reported to us in writing within 3 days of despatch
If we or our delivery contractors are unable to effect a delivery because no-one is available to sign for its safe receipt and the goods are consequently returned to us, we reserve the right to recover from any refund due our initial delivery costs and any costs incurred in having the goods returned to ourselves in the first place. Any required re-delivery may be subject to an additional delivery charge.
All items are guaranteed for 12 months Parts & Labour, excluding HP Hoses (30 days only), Fair Wear & Tear, Abuse, Neglect, Lack of Maintenance, Misuse, Tampering, Contamination, Frost or Physical Damage. Should an item develop a fault or cease to work, please contact us in the first instance. For large items of equipment or plant delivered within our On-Site Service Area, these will be attended to by an engineer at your premises, usually within 24 hours but generally no more than 72 hours from you reporting a breakdown. For portable or smaller items, you will need to return the item to us at your own expense and until it reaches us, it will remain your responsibility. Before returning the item, please obtain a returns number (RMA) from us, quoting this clearly on the packaging and including a copy of your purchase invoice or delivery note. We will usually repair or replace a faulty item within 5 working days from its receipt.
We aim to provide first class after-sales service and support. If it is subsequently found that an item returned to us (or attended to by us) under a warranty claim has been subject to abuse, neglect, lack of maintenance, misuse, tampering, contamination, dust/water ingress, fair wear or tear, frost or physical damage, you will then be responsible for all standard labour, carriage, parts, travel and callout costs incurred by us to effect a repair or replacement. Any repair undertaken within the warranty period will continue to be covered by the remaining warranty period until its expiry. In all other cases (including repairs outside of the warranty period, routine servicing or used equipment sold by us) the warranty will be limited to 3 months from the date of repair, service or sale, subject to the same exclusions as above.
We shall not be liable to you for any loss or damage to you as a direct or indirect result of any of our duties and/or obligations being prevented, hindered, delayed or rendered uneconomical by acts of God, war, riot, strike, lock-out, industrial action, accident, breakdown of plant or machinery, hire of plant or machinery, fire, flood, drought, storm, difficulty or increased expense in obtaining materials, or other reasons beyond our reasonable control.
Save for any item incorrectly supplied, we may at our discretion accept unwanted or unsuitable stock items provided they; are returned within 7 days of delivery with our prior written authorisation; are returned at your own expense and risk until received by us; have been unopened; are in their original and undamaged packaging; have not been used or marked whatsoever; still remain in a saleable condition; and the original purchase invoice (not a copy) accompanies the item. A refund will then be made within 28 days subject to a 25% restocking and handling charge, less any carriage charges paid or, in the case of original free delivery, less a packing charge of £10.00 + VAT. Special orders, installations, custom-made or adapted equipment are non-returnable.
